1. Definitions
For the purposes of these Terms & Conditions:
- "Facility" or "Velvet Elm" refers to the residential care home located at 210/5 Thanon Mittraphap, Mueang Nakhon Ratchasima, Nakhon Ratchasima 30000, Thailand.
- "Resident" refers to the individual receiving residential care services at Velvet Elm.
- "Family" or "Representative" refers to authorized family members or legal representatives acting on behalf of the Resident.
- "Services" refers to residential care, accommodation, meals, personal assistance, and programs provided by Velvet Elm.
- "Agreement" refers to the residential care contract entered into between Velvet Elm and the Resident or their Representative.
2. Acceptance of Terms
By enrolling a Resident at Velvet Elm or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not proceed with enrollment or service use.
Residents must be at least 60 years of age. Representatives entering into agreements on behalf of Residents must be legally authorized to do so and must be at least 18 years of age.
3. Service Description
3.1 Scope of Services
Velvet Elm provides non-medical residential care services, including:
- Private or shared accommodation with furnishings and climate control
- Three daily meals prepared according to dietary requirements
- Personal care assistance with mobility, daily routines, and household tasks
- Housekeeping and laundry services
- Access to communal spaces, gardens, and facilities
- Optional cultural activities and social programs
- Coordination with external healthcare providers when needed
3.2 Services Not Provided
Velvet Elm does not provide:
- Medical or nursing care services
- Medication administration (Residents must self-administer or arrange external support)
- Intensive care for individuals requiring continuous medical supervision
- Transportation to medical appointments (can be arranged separately)
3.3 Service Availability
Services are provided 24 hours daily, 7 days weekly. Cultural activities and outings operate on scheduled basis as outlined in monthly program calendars. Velvet Elm reserves the right to modify activity schedules with reasonable notice to Residents.
4. Admission Requirements
4.1 Assessment Process
Prior to admission, prospective Residents undergo an assessment to determine suitability for non-medical residential care. This assessment includes review of:
- Current health status and care requirements
- Mobility and independence levels
- Dietary needs and preferences
- Social engagement preferences
- Any behavioral or cognitive considerations
4.2 Required Documentation
The following documents must be provided before admission:
- Completed application form and personal information
- Medical history and current health summary from physician
- Emergency contact information
- Copy of identification documents
- Signed residential care agreement
- Initial payment as specified in fee schedule
4.3 Right to Decline Admission
Velvet Elm reserves the right to decline admission if assessment determines that our facility cannot safely or appropriately meet the prospective Resident's care needs.
5. Fees and Payment
5.1 Monthly Fees
Residential care fees are charged monthly and vary based on the selected care option:
- Community Room Residency: ฿12,500 per month
- Isan Cultural & Social Program: ฿12,800 per month
- Private Garden Room with Personal Aide: ฿74,500 per month
All fees are quoted in Thai Baht (฿) and include accommodation, meals, personal care, housekeeping, and access to standard activities and facilities.
5.2 Payment Terms
Monthly fees are due on the first day of each month. Payment may be made by:
- Bank transfer to designated Velvet Elm account
- Cash payment at facility office
- Check payable to Velvet Elm
Late payments beyond 7 days may incur a late fee of ฿500. Accounts more than 30 days overdue may result in suspension of services.
5.3 Fee Adjustments
Velvet Elm reserves the right to adjust fees annually with 60 days written notice to Residents and Families. Fee increases will not exceed reasonable cost of living adjustments.
5.4 Refund Policy
If a Resident departs before the end of a paid month, fees will be prorated on a daily basis for unused days. Refunds will be processed within 30 days of departure. Initial admission fees are non-refundable.
6. Resident Responsibilities
Residents and their Families agree to:
- Provide accurate and complete information during admission and throughout residency
- Notify Velvet Elm promptly of changes in health status or care needs
- Respect other Residents, staff, and facility property
- Comply with facility rules regarding safety, quiet hours, and communal living
- Pay all fees in a timely manner as specified
- Maintain personal belongings in good condition and label items appropriately
- Participate in periodic care reviews and assessments
7. Facility Responsibilities
Velvet Elm commits to:
- Provide services as outlined in residential care agreements
- Maintain safe, clean, and comfortable living environments
- Treat all Residents with dignity, respect, and cultural sensitivity
- Protect confidentiality of personal and health information
- Communicate openly with Families regarding Resident wellbeing
- Provide reasonable accommodation for individual preferences when possible
- Maintain appropriate liability insurance coverage
8. Termination
8.1 Voluntary Termination by Resident
Residents or their Representatives may terminate residency at any time with 30 days written notice. Early departure without notice will result in forfeiture of current month's fees.
8.2 Termination by Velvet Elm
Velvet Elm may terminate residency with 30 days notice under the following circumstances:
- Resident's care needs exceed non-medical residential care scope
- Resident's behavior poses safety risk to self, other Residents, or staff
- Failure to pay fees for more than 30 days
- Breach of material terms in residential care agreement
Velvet Elm will work with Families to identify appropriate alternative care arrangements when termination becomes necessary.
8.3 Emergency Termination
Immediate termination without notice may occur if Resident's behavior creates imminent danger to safety or wellbeing of others at the facility.
9. Limitation of Liability
Velvet Elm maintains reasonable care standards but cannot guarantee prevention of all accidents, illness, or personal loss. Our liability is limited as follows:
- We are not liable for loss or damage to personal property unless caused by gross negligence
- We are not responsible for medical outcomes as we do not provide medical services
- In any claim, our maximum liability is limited to six months of Resident's monthly fees
- We are not liable for injuries resulting from Resident's own actions against staff advice
Families are encouraged to maintain appropriate insurance coverage for personal property and health care costs.
10. Indemnification
Residents and Families agree to indemnify and hold harmless Velvet Elm, its staff, and affiliates from claims arising from Resident's actions that cause harm to others or property, excluding claims arising from Velvet Elm's negligence.
11. Dispute Resolution
11.1 Informal Resolution
Parties agree to first attempt resolution of disputes through good faith discussion with Velvet Elm management. Most concerns can be addressed through open communication.
11.2 Mediation
If informal resolution fails, parties agree to participate in mediation before pursuing legal action. Mediation costs will be shared equally.
11.3 Governing Law
These Terms & Conditions are governed by the laws of Thailand. Any legal proceedings will be conducted in courts of Nakhon Ratchasima Province.
12. General Provisions
12.1 Entire Agreement
These Terms & Conditions, together with the signed residential care agreement and fee schedule, constitute the entire agreement between parties.
12.2 Severability
If any provision is found invalid or unenforceable, the remaining provisions continue in full force.
12.3 Waiver
Failure to enforce any provision does not constitute waiver of that provision or any other provision.
12.4 Assignment
Residential care agreements may not be assigned or transferred without written consent of Velvet Elm.
12.5 Notice
All notices must be provided in writing to the registered address or email on file. Email notices are considered received within 24 hours.
13. Changes to Terms
Velvet Elm may update these Terms & Conditions periodically to reflect operational changes or legal requirements. Material changes will be communicated to Residents and Families with 60 days notice. Continued residence after notice period constitutes acceptance of updated terms.
